STATEMENT OF TOM EHMAN

Spokesperson, Golden Gate Yacht Club

San Diego, – We are very pleased that today’s Court decision gives

us clarity regarding the design rules that will govern AC33. It is now crystal clear that

racing rules 49 through 54 will not apply.

However, without racing rules 49-54, SNG is breaking with the longstanding history and

tradition in yacht racing that prohibited the use of non-manual power. For the first time in

the Cup’s history, engines will be permitted to trim the sails, and computers can be used

to control and steer the yachts. This, we believe, is a sad day for the America’s Cup.

While we are pleased with the design-rule certainty, we are disappointed that the Court

has said that SNG can change the other racing rules at any time up to the start of the

Match. We do not believe this is what the Deed says, nor what the donors intended, and

are currently reviewing our options in this regard.

We are pleased that Justice Kornreich has ordered SNG to provide us the secret

agreement SNG entered into with ISAF.

We look forward to the hearing on August 10th to clear the air on the CHR matter. We

are confident we can demonstrate to the Court when it “would be practicable for [GGYC]

to provide a CHR.”

Déclaration de Fred Meyer, Vice-Président de la Société Nautique de Genève, yacht-club Defender de la 33e America's Cup, suite à la décision de la Cour Suprême de New York rendue aujourd'hui : "Nous sommes très heureux de l'ordonnance rendue par le Juge Kornreich. Cette décision montre qu'elle comprend parfaitement les droits du Defender en vertu du Deed of Gift, pour lequel il est du devoir de la Société Nautique de Genève (SNG) de fixer les règles de la 33e America's Cup à venir. L'ordonnance du juge valide également l'accord dans lequel s'est engagée la SNG auprès de l'ISAF (Fédération Internationale de Voile) prouvant sa ferme volonté de ramener la compétition sur l'eau, là où elle doit se disputer. Nous attendons avec impatience l'audience du 10 août et le Certificat Custom House du Golden Gate Yacht Club, qui permettra à Alinghi de se préparer comme il se doit à sa défense.

Statement from Fred Meyer, 33rd America's Cup defending yacht club, Société Nautique de Genève Vice-Commodore, following the New York Supreme Court decision published today: “We are very pleased with today's ruling by Justice Kornreich. This decision reflects her clear understanding of the Defender's rights under the Deed of Gift, which makes it the duty of Société Nautique de Genève (SNG) to set the rules for the upcoming 33rd America's Cup. The judge's order also validates the agreement entered into by SNG with the International Sailing Federation (ISAF), demonstrating that SNG is committed to returning the competition to the water where it belongs. We look forward to the 10 August hearing and to receiving the Golden Gate Yacht Club's Custom House Registry, which will enable Alinghi to properly prepare for its defence.”

Response to Tom Ehman in Valencia Sailing

“Tom Ehman’s interview in Valencia Sailing deserves an appropriate response:

 

In almost 140 years of America’s Cup competition, innovation is often accompanied by whines of “illegality” or “unfair” from the other camp. Alinghi however, cannot take any innovation credit in using powered systems, and Tom Ehman’s predictable whines are again wide of the mark. Onboard powered systems have been with the top end of the sport for more than a dozen years. Just take a closer look at the yachts competing in blue ribbon events such as the Sydney-Hobart, Newport to Bermuda, Volvo Ocean Race, Transpac as well as some World Championships such as the Maxi Worlds. Are they all cheats too, Tom?

 

If the new self-appointed purists of the sport are upset at the use of onboard powered systems, they need to take it up with the innovators of the game, but they have not only missed the boat, they have been missing it for years.

 

Can anyone fairly criticise Alinghi for using the best technology in what is an open design competition? Anyone reading the Mercury Bay judgements can read in simple black and white terms that there are no design rules except the broad dimensions specified in the Deed, and within these the challenger is free to commit to the dimensions of their yacht when making its challenge and the defender is free to respond. You can be sure the BMW Oracle designers are not thrilled to hear someone on their side might have put them wrong on the rules.

 

Now Tom Ehman is trying to sell us Mercury Bay and the 27th Match in 1988 as some kind of Californian “love-in”. That will come as a big surprise to those who lead and bankrolled the Mercury Bay Challenge and the three years of litigation it involved. Eight court hearings up and down the New York court system was just a bit of fun? No, mutual consent was as short on the ground then as it is now. The litigation might have been fun for Tom back in 1988 just as it seems to be to him now, but no one else is smiling Tom. The business of the Cup is in ruins but the Deed must prevail. Make no mistake; the Mercury Bay Boating Club contested the rules of the 27th Match produced by Tom Ehman right up to the very end. The measure of a man is how he takes his own medicine.

 

Next Tom Ehman wants to litigate the venue selection. He has flipped-flopped on this as well. He publicly announced last year after the Court’s order was made, that the Defender could choose a venue anywhere it wished, in either hemisphere. Only two months ago in May they issued press statements critical of Alinghi for what they said was defying the Court’s order in respect of the dates of the Match, which conflicted with the terms of the Deed of Gift. Now Ehman wants Alinghi to ignore the same Court order (and the Court’s subsequent directions), and follow the Deed in selecting the venue. How does he lie in bed straight?

 

Ehman is signaling he wants to start yet another round of litigation, this time over construction in country. Ehman’s no holds barred Cup philosophy hasn’t changed much since 1991 when he ran the Cup Organisation into near bankruptcy needing a massive bailout when he said:

 

“The challengers will do everything they can do to try to weaken us financially and operationally," said ACOC General Manager Tom Ehman. ”It is part of the battle, unfortunately, that carries over from the water onto the land. It's a little bit unfair."

 

Regrettably, the years don’t seem to have brought any maturity and wisdom.

 

Alinghi 5 has been constructed in Switzerland as required by the Deed and is now sailing in Switzerland. Despite Ehman’s rhetoric painting their challenge as an American product, it is hardly the “All American” challenge he would have us believe. Tom is careful not mention the overwhelming presence of Kiwis, Australians, Canadians, Irish, Brits, Dutch, French, Italians” - and that’s just the sailors, and it is not much different in other parts of the team including those who constructed their boat.

 

It is all but forgotten that it was another Californian yacht club that had the dubious distinction of being the very first to commence litigation over the Cup competition when the San Diego Yacht Club sought an injunction against the Royal Perth Yacht Club in 1985 (NYSC Index Number 22320/85) before the 26th America’s Cup in Fremantle over the rules of the regatta. That may have been 24 years ago, but some things just don’t change.

 

Ehman has signaled BMW Oracle will be desperately continuing to throw the dice in court for a while longer, and blaming the other side for their actions. The rest of the sport is thoroughly bored with their legal antics and increasingly ludicrous PR spin, and just wants us to get on with a race on the water.

 

Is anyone willing to bet they will not litigate again if they lose in February? I mean losing is just so unfair, eh Tom.”

Alinghi 5 : "Un hommage à l'équipe"

Alinghi, Defender de la 33e America's Cup, a tenu aujourd'hui une conférence de presse au Bouveret en Suisse pour présenter son catamaran géant Alinghi 5.

Si le bateau est resté à quai aujourd'hui en raison des conditions météo exécrables sur le Lac Léman, les premiers essais en début de semaine se sont révélés très concluants. "Voir Alinghi 5 réaliser de si bonnes performances pour sa première sortie en mer est un véritable hommage à l'équipe, d'abord et avant tout aux architectes, qui ont puisé dans la technologie et le patrimoine suisse des multicoques autant que dans leur propre expérience, mais aussi à l'équipe du chantier et aux marins qui consacrent aujourd'hui tous leurs efforts à rendre le bateau le plus rapide possible. Cette première navigation à bord d'Alinghi 5, que nous avons fait voler sur une coque, est sans nul doute l'un des plus beaux jours de ma vie", a déclaré le président de l'équipe, Ernesto Bertarelli.

Les tests vont se poursuivre dans les jours à venir, avec en point d'orgue une présentation de l'équipe et une parade entre Lausanne et le club du defender, la Société Nautique de Genève, dans le cadre d'une célébration publique le 1er août. Le bateau sera ensuite préparé pour être transporté par hélicoptère jusque Gênes en Italie où continueront les entraînements.

“Ce projet a toujours consisté à rassembler des gens pour leur faire vivre socialement et intellectuellement des choses exceptionnelles. La question n'est pas de savoir qui gagnera devant les tribunaux, mais qui sera le plus rapide sur l'eau avec la meilleure équipe et les meilleures technologies. C'est pour cette raison que nous sommes ici et nous en sommes fiers", conclue Ernesto Bertarelli.

Ernesto Bertarelli était entouré de Grant Simmer, coordinateur du design team, de Murray Jones, membre du sailing team et responsable des premiers tests et Patrick Aebischer, président de l'EPFL, conseiller scientifique d'Alinghi.

Alinghi 5: "A tribute to the team"

Alinghi, the Defender of the 33rd America's Cup, held a press conference today in Le Bouveret, Switzerland, to present Alinghi 5, the Swiss team's giant catamaran.

The boat was held ashore for the day as the weather turned foul on Lake Geneva, but the first trials held earlier this week were extremely successful: “Being able to sail Alinghi 5 on the Lake for the very first time and seeing it perform so well on its first day out is a real tribute to the team; first and foremost the designers – who have drawn from the multihull heritage and technology here in Switzerland as well as their own depth – but also the boat builders and the sailors who are now completely focused on making the boat go as fast as possible. Our first day out, flying a hull was, if not the best, certainly one of the best days of my life,” said team president, Ernesto Bertarelli.

Sailing and testing will continue apace over the coming days culminating in a public celebration on Lake Geneva on 1 August which will include a team presentation before a parade of sail from Lausanne to the defender's club, Société Nautique de Genève. The boat will then be prepared for the heli-lift to Genoa, Italy, where training will continue.

“This project has been, and continues to be, about putting people in a position where they can socially and intellectually experience things that are unique. It's not about who is winning in court; it's about which is going to be the fastest boat on the water with the strongest team and the best technology. That is why we are here and we are proud of it,” concluded Bertarelli.

Ernesto Bertarelli was flanked by Grant Simmer, design team coordinator; Murray Jones, member of the sailing team who has been running the early trials and Patrick Aebischer, president of EPFL, Alinghi's scientific advisor.

Déclaration de Brad Butterworth suite à l'audience devant la Cour Suprême de New York

Brad Butterworth, skipper du team Alinghi, s'est exprimé après l'audience devant le Juge Kornreich de la Cour Suprême de New York:

“C'est une bonne chose que le Juge Kornreich ait refusé la requête du Golden Gate Yacht Club (GGYC) visant à suspendre le yacht club defender de l'America's Cup, la Société Nautique de Genève (SNG), par un outrage à magistrat, mais ce n'est pas vraiment une surprise car il n'y a pas de place pour de telles actions.

Le Juge Kornreich a montré qu'elle connaissait parfaitement le dossier et l'affaire et bien qu'elle ait réservé sa décision, elle a clairement précisé que les clauses du Deed of Gift ne mettent aucune restriction sur le design du bateau. Elle a également demandé aux deux parties de reprendre la méditation interrompue par la dernière tentative de contentieux du GGYC.

Nous sommes prêts et nous voulons poursuivre les discussions avec eux, et nous ferons tout clarifier la situation autour de la 33e America's Cup autant que les règles et les procédures nous le permettent et toujours dans le cadre du Deed of Gift et des règles de la SNG. Nous sommes déterminés à remettre la compétition sur l'eau et à sortir des tribunaux une fois pour toutes".

Brad Butterworth statement following today's NY court hearing

Brad Butterworth, Alinghi team skipper, gives a statement following today's hearing before Justice Kornreich in the NY Supreme Court:


“It's good that Justice Kornreich denied the Golden Gate Yacht Club's (GGYC) request to hold the America's Cup defending yacht club, Société Nautique de Genève (SNG), in contempt of court, but it doesn't come as a surprise because there were no grounds for such an action.

Justice Kornreich showed a great deal of knowledge of the file and the case and while she reserved her decision, she made it crystal clear that the provisions of the Deed of Gift put no restriction on yacht design. She also asked both sides to return to the mediation that the GGYC halted with this new litigation attempt.

We are ready and willing to continue discussions with them and will work on providing clarity with regards the 33rd America's Cup as far as rules and measurement procedures go; always within the framework of the Deed of Gift and SNG's rules. We are determined to get the competition on the water and out of the courtroom once and for all.”

Alinghi 5 sails for the first time on Lake Geneva

The Swiss America’s Cup Defender, Alinghi, hoisted the sails on its giant new catamaran Alinghi 5 for the first time today on Lake Geneva, Switzerland. The 90ft multihull was cheered off the dock at midday by hundreds of spectators watching the maiden sail out of Le Bouveret.

 

Murray Jones, who is running the initial trials of the giant multihull that represents a first step in the development process towards the 33rd America’s Cup, gave his comments on a good first day on the water: “We went out this morning with a list of objectives to work through: testing the boat, checking the structure, doing some manoeuvres and seeing if the sails would all sheet and it went pretty well; we ticked off just about everything. There are a lot of systems on the boat that are complicated and new, but it was fantastic. To fly the boat upwind and downwind with gennaker was awesome for the first day of sailing. The boat is a tribute to the designers and the boat builders. To deliver a boat of this complexity that works straight out of the box on the first day is impressive; really impressive.”

 

Grant Simmer, design team coordinator, was observing the trials from a RIB: “It’s been a good day, we had a list of things we wanted to tick off and we took it slowly and carefully and have finished the day achieving all those things. It was exciting to see the boat sailing for the first time after so much time designing, boat building, sail making and spar making; seeing all those bits come together and seeing the machine working is great! We’re looking forward to tomorrow.”

 

 

 

This multihull – the culmination of 100,000 man-hours – was launched on 9 July by helicopter and will continue to sail on the Lake over the coming weeks.

33rd America's up Rules ... Announced!

33rd America's Cup

 

The International Sailing Federation (ISAF), the world governing body of the sport, and the Societe Nautique de Geneve (SNG), the trustee and holder of the America's Cup, are pleased to announce that the 33rd America's Cup Match will be conducted under the Deed of Gift provisions, the SNG rules, the ISAF Racing Rules of Sailing and ISAF Regulations as required by the Deed of Gift.

Any changes to the ISAF Rules and Regulations not already covered by provisions within the ISAF Rules and Regulations will require sanction from ISAF.

The Principal Race Officer, International Jury members and International Umpires (if Appendix C is used), will be suitably qualified personnel and will be independently appointed by ISAF.
The process of which has already begun.

Loïck Peyron rejoint Alinghi pour la 33e America's Cup

Alinghi, Defender de la 33e America's Cup, accueille dans son équipe l'un des plus grands spécialistes mondiaux du multicoque, Loïck Peyron. À 50 ans, le Français compte à son actif pas moins de 43 traversées de l'Atlantique dont 18 en solitaire. Il a également bouclé deux tours du monde en course et remporté trois Transat Anglaise et deux Transat Jacques Vabre. “Tous les marins pensent un jour à l'America's Cup”, a déclaré Loïck Peyron. “Je suis l'événement depuis de nombreuses années et aujourd'hui je suis fier de travailler pour une équipe comme Alinghi. Il reste énormément de travail à faire mais c'est un formidable défi. Un des points forts d'Alinghi est de réunir différents types de compétences, des monocoques, de la course au large, et bien sûr des multicoques, notamment des multicoques suisses. L'esprit d'équipe est très fort chez Alinghi et cela fonctionne très bien. Ils l'ont déjà prouvé plusieurs fois. Comme tout le monde ici, j'ai hâte de sortir naviguer pour tester le potentiel de cette incroyable machine.”

Brad Butterworth, skipper du team Alinghi et quadruple vainqueur de l'America's Cup est heureux d'accueillir le skipper français : “Nous avons hâte de travailler avec Loïck. Il a une grande expérience du multicoque, à la fois en termes de design et de navigation, et il rejoint une équipe qui a déjà un certain potentiel dans ce domaine. Loïck Peyron joins Alinghi for the 33rd America's Cup

Alinghi, Defender of the 33rd America's Cup, welcomes one of the world's most renowned multihull sailors to the team for this campaign: Loïck Peyron. The 50 year old Frenchman has crossed the Atlantic 43 times; 18 single-handed. He has raced around the world twice, holds three Transat titles and two Transat Jacques Vabres: “In every sailor's mind, the America's Cup is part of life. I have been following it for many years and now to be working for a team like Alinghi makes me proud," Peyron said, adding: "There is a tremendous amount of work for sure, but it's a big challenge. An interesting strength of Alinghi is that it has a lot of knowledge from a lot of areas of the sport: monohulls, offshore sailing, multihulls; especially here in Switzerland. The way the team works is based on team spirit and the method works really well; they have proved it many times. Now like everybody here, I am impatient to go and sail on the lake to see the potential of this amazing machine.”

KNUT FROSTAD REFLECTS on the latest Volvo Race

Knut Frostad, Volvo Ocean Race CEO, takes time out to reflect on the challenges and achievements of the ground-breaking 2008-09 race and provides an update of the outline plans for the next event.

Q: What have been the main differences in your experience of the race from competitor to organiser?
A: There are so many stakeholders in this event with so many objectives it is extremely important to crystallise an overall strategy and a set of objectives that work for everyone and enable you to work together towards a common goal.

Of course the overall objective of the teams is to win the race and to maximise the return on investment for sponsors. This race is really about managing expectations, about managing the unforeseen and the unpredictable whether, you are a sailor or a CEO.

You have learn to deal with things at very short notice. A lot of things in the world are predictable, this race is not. As organisers, this is also a race around the world. As organisers, often we don't know what we are dealing until it lands on our table. You have to shoot from the hip to some extent. I like the challenge of dealing with that unpredictability. It is very similar to racing.

Q: What challenges have you faced in organising the 2008-09 event?
A: Actually I've discovered that we get thrown a lot more challenges than I imagined we were going to get. This race is a huge mountain to climb and the satisfaction of getting on top of those challenges is immense even if you don't win. It is the essence of this race whether you are a sailor or an organiser. Green Dragon has been a good example of that.

It has been a struggle for them to get to the start line but they have worked really hard to get round the world in this race and at the same time they have performed very well on some legs. They can look back now and feel proud that they did something really big. Similarly we set ourselves tough objectives as organisers and I am pleased that in most case they were met.

Q: What do you see as successes?
A: It is impossible for me to compare the last race as a competitor with this race as a CEO because I am not looking for the same issues. As a competitor you don't really have a sense of how big the crowds were or how media coverage was generated because you don't really have that focus. So, the only measurement I can go on are the numbers we recorded. From a competitive aspect, the biggest positive for me was the closeness of the racing.

This has been the toughest competition in the race's history, the closeness of the racing between the fleet has been exceptional. So many teams have been on the podium. The margin of Ericsson 4's victory was only nine points. We could have easily had another boat other than Ericsson 4 winning.

Although Ericsson 4 has been talked about a lot as being superior she hasn't been that superior. I could see that there could have been another boat winning overall. Telefónica Blue or PUMA, for instance, could have won this race if things went right for them in certain areas and on certain legs. Still Ericsson 4 did a great job and deserved their win in every way.

Another highlight was the globalisation of this event. It had a very strong international flavour among the sailing crews, the race village visitors and the media. The footfall figures were much bigger in this race. The crowd numbers we had in Alicante, Galway, Stockholm, Cochin and Qingdao were huge. That has been really positive. We have demonstrated that the event works on new and innovative platforms like the mobile channel and the online game where we had over 220,000 players from over 180 countries.

Q: How have the new territories embraced the race?
A: It is extremely important for the race to explore new regions and new countries such as China. The public reception the race received in Qingdao, for instance, was enormous with nearly 400,000 visitors to the race village. China accounted for 65% of WAP traffic on the race's mobile channel. Through a partnership with CCTV, we reached an audience of over 260 million by the midway point of the race and the Qingdao stopover attracted 420 journalists from eight different countries.

One of our objectives from the Qingdao stopover was to bring awareness of sailing to the country and stimulate interest and ultimately involvement among young Chinese sailors. The fact that we had a Chinese-Irish boat in the 2008-09 race and having Chinese sailors among the crew of the boat helped that process enormously.

China has managed in a very short period of time to become a very big player in the Volvo Ocean Race. China took the race for what it is and said it's an extreme sport, round the world, a huge challenge and Guo Chuan, the Chinese sailor on Green Dragon, did a good job. It was a refreshing and positive approach.

Q: Where do you see areas for improvement?
A: In some cases we have made it way too hard for ourselves. We started too late. Even three months before the start there was a lot to do. There were a number of things that could have been done earlier. We have to acknowledge that for organisers, competitors and stakeholders, time is the most valuable asset.

Ericsson started earlier than the other teams, that's why they were better prepared and why their all-round performance was better than their rivals. It's the same thing for us, time is absolutely essential. So for 2011-12 we need to get going much earlier.

Q: How are plans progressing for the 2011-12 race?
A: There are some solid foundations in place for the future of the race. The port of Alicante has committed to hosting the start of the next three editions of the race. The race headquarters will also locate to Alicante where we will have the infrastructure to begin the planning for the next event.

We already have a commitment from a number of syndicates to participate in the next race and the port bidding process is well advanced. We have had a huge response from ports around the world wanting to become part of the next race. We have undertaken a thorough review of the race and sought feedback from a number of stakeholders.

We have focused on cost-cutting while safeguarding the competitive element of the event.  We have identified areas where we can make saving across the board for entries in the next race. Commercially we have never been stronger even in a difficult economic climate globally. Even in tough times, you have winners and we absolutely shall be one of those winners.

Q: What is the provisional entry list looking like?
A: From a competitive sense we have close to 50 teams at various levels that are interested. There are a lot of names that I always wanted to see in this race that are now interested in getting on the start line. That includes competitors and sponsors and particularly the French. There is a real hope that we will have a French team in the race.

Among the present fleet, the majority is looking to participate again with the same sponsors. I can't recall that happening before. We had Ericsson returning from last time and you could argue that Telefónica is the same company coming back from 2005-06. Now we also have PUMA and Delta Lloyd working on getting on the start line. That is very positive. The race is a really a great opportunity right now.

Q: How different will the new rule be?
A: Obviously the new rule takes account of the full-scale review we have been undertaking during this race. It will reflect in particular the areas of cost savings we have identified we can make in certain areas. Those are savings that are easily achievable. We have looked at absolutely everything to see where we can make those savings.

We have managed to do as much as we could in the time frame we have set. For sure if we had more time we could have done even more, but at some stage you have to say, this is it. You have to have a cut-off point. We are working towards announcing the new rule at the end of September.

Q: What are your aspirations for the race in the long-term future?
A: I have thought a lot about how we take this race forward and how we develop it. Although we are looking at what works in other sports, we also have to remember what the core of this event is. The unpredictability is one of the core elements that makes this race unique. The fact that we are taking this race around the world creates that type of environment. We have to ensure that we are as well prepared as we can be for when those surprises arrive.

The global platform is unique for our race along with the heritage and history we bring with us. I want to widen our audience way beyond where we are today. Based on what we achieved in the 2008-09 race and the platform we have built for 2011-12 and beyond, the future looks very bright.

The latest Golden Gate Yacht Club legal action

America's Cup Defender, Société Nautique de Genève (SNG), statement in reaction to the latest Golden Gate Yacht Club legal action: "It is again a disappointment that the Golden Gate Yacht Club (GGYC) chooses to pursue its litigious strategy instead of fighting for the America's Cup on the water. It is now the fourth time the American team goes to court, this time in an attempt to prevent the SNG's legitimate right to use its yacht club rules – as prescribed in the Deed of Gift – and the ISAF rules and regulations to their full extent, as it has been the case in previous editions of the America's Cup and in any international regatta in the world. While GGYC continues to put pressure on the SNG through the New York courts, SNG continues to wait for the GGYC to provide their yacht's Custom House Registry as soon as possible, as per the Deed of Gift and the New York court decisions."

Dear Vice-Commodore Meyer,


Let us again reiterate, the Deed and the Order and Judgement are clear that you may not select a Northern Hemisphere venue, other than Valencia, without our mutual consent. Justice Kornreich's May 14th order contains nothing that even suggests, let alone "stated", otherwise. To the contrary, Justice Kornreich ordered "SNG to hold the race as per the order of the Court of Appeals and Justice Cahn in February as the order required."

As further proof that our reading of the Deed and the Judgement and order is correct, you agreed with it when light and truth were original to you. In your May 11, 2009, court papers you agreed that "the Deed of Gift unambiguously prohibits sailing a match between November 1 and May 1 in the Northern Hemisphere... There is nothing in the order that suggests that a race should be held in contravention of the terms of the the Deed of Gift."

What is more, during the May 14th hearing when your attorney attempted an about face by asserting that SNG has the right to select a Northern Hemisphere venue other than Valencia without our consent, Justice Kornreich stated that "that's not what the Court of Appeals said".

Your letter also again fails to respond to the inescapable conclusion that the Deed and the Order and Judgement my be read harmoniously, giving force and effect to the terms of each, requiring a February race in Valencia or any other Southern Hemisphere location selected by SNG, unless otherwise consented to by GGYC. There is therefore no basis to conclude that the phrase "any other location" in the Order and Judgement intended to alter the Deed of Gift's Northern Hemisphere restriction; just as there is no basis to conclude that this phrase intended to alter the Deed's requirement to select a location free of headlands or a location that has an ocean water course.

You also misconstrue Justice Kornreich's order and the Deed when you assert that they require GGYC's Custom House Registry to "conform exactly" to GGYC's challenge certificate. To the contrary, the Deed is unambiguous that the dimensions provided on a challenge certificate "shall no be exceeded". Justice Kornreich's order is entirely consist with the Deed and the Order and Judgement; and you are simply wrong in your repeated assertions that Justice Kornreich's order in any way contravened the terms of the Deed or the mandate of the Court of Appeals.

Alinghi met à l'eau son catamaran géant par hélicoptère sur le Lac Léman

À 16h00 cet après-midi, Alinghi 5, le nouveau catamaran du Defender suisse de l'America's Cup, est extrait de la tente où il a été construit à Villeneuve en Suisse. Il s'envole soulevé par un Mil Mi-26, le plus grand et le plus puissant hélicoptère au monde, pour être mis à l'eau sur le Lac Léman.

Alinghi 5 est la première étape du processus de développement en vue de la 33e America's Cup. L'équipe va maintenant se concentrer sur la préparation du bateau pour sa première sortie en mer dans les semaines à venir.

Ernesto Bertarelli, président d'Alinghi, était sur place pour féliciter l'équipe et pour le baptême du bateau dont la marraine n'est autre que sa femme Kirsty. "En tant que marin passionné de multicoque, je suis très heureux de voir le bateau toucher l'eau et d'assister au commencement d'une nouvelle étape pour ce projet. Au cours des semaines et des mois à venir, l'équipe va se préparer à défendre la 33e America's Cup qui se disputera l'année prochaine. L'équipe a fourni un excellent travail pour en arriver là. Nous avons maintenant tous hâte d'aller naviguer".

"Je suis très fier de ce que nous venons de réaliser", a déclaré Grant Simmer qui a travaillé aux côtés des architectes, des boat builders et des marins et a coordonné l'ensemble du projet. "Il y a eu tant de gens impliqués et chacun a travaillé très dur. Ils ont fait du très beau travail et voici le fruit de leurs efforts".

Alinghi launches its giant catamaran on Lake Geneva by helicopter

At 16:00 this afternoon, Alinghi 5, the Swiss America's Cup Defender's new catamaran, was lifted out of the tent where it was built in Villeneuve, Switzerland, and into the air by a Mil Mi-26 helicopter, the biggest and most powerful in the world, to be launched on Lake Geneva.

Alinghi 5 represents a first step in the development process towards the 33rd America's Cup and the team will now focus on preparing it to sail over the coming weeks.

Ernesto Bertarelli, Alinghi team president, who was present to congratulate the team and for the boat christening by his wife Kirsty, commented: “As a passionate multihull sailor I am extremely excited to see Alinghi 5 launched and for the next stage of this campaign to begin: over the coming weeks and months the team will work towards defending the 33rd America's Cup next year. The team has done an excellent job to make this happen; we are all looking forward to going sailing now.”

Watching as the helicopter lifted Alinghi 5 out of the tent and on to the water, Grant Simmer who, working alongside a team of designers, boat builders and sailors, has coordinated the project said: “I feel very proud of what we have achieved; there have been so many people involved who have worked really hard. They have done a fantastic job and this is the product of their hard work.”

Alinghi catamaran unveiled

Alinghi, the Defender of the 33rd America's Cup, unveiled its 90ft catamaran this weekend in Villeneuve, Switzerland. This multihull represents a culmination of Swiss multihull heritage and is the first step in Alinghi's development process towards the 33rd America's Cup in February 2010. The boat will be launched by helicopter next week on Lake Geneva before the process of ‘debugging' begins and the boat goes sailing for the first time.   

Grant Simmer, design team coordinator, comments on the achievement: “Firstly this boat only exists because of Ernesto Bertarelli's 100% commitment to the team and his support and enthusiasm for this project. The boat demonstrates the talent and creativity of the designers and the skill and dedication of the boatbuilding and technical teams in building a boat of this complexity, facing many different challenges along the way and solving them to pull the project together. Finally, and more recently, the sailing team has defined many of the systems; they have worked with the designers to define the simplest possible solutions for what is already a very complex boat.”   

Rolf Vrolijk, chief designer: “People who see the boat for the first time seem surprised at how light and fragile it looks, that is really their first impression. Creating it has been a huge team effort, both in the design and the build groups; it has been a phenomenal team effort to come up with the concept and it really represents the depth of our group. For the moment we have pushed the envelope as much as we would like, this boat is really a base for further development and over the coming weeks we will collect as much information as we can and cross check it with the predictions, this will help us assess what level we are at and then to optimise from there. We have several opportunities and possibilities to change the concept but first we need a solid base to do our studies from.”   

Murray Jones, strategist and design team responsible for mast and rig programme: “This multihull is nothing like you've ever seen before in a big boat. It's like a small boat but scaled up. It's a highly finely tuned and engineered boat that's light. It's a piece of art. Alinghi 5 has evolved from the Swiss sailing boats, like the 41ft ‘Le Black'. The basic engineering concept has come from ‘Le Black' but everything else has come from the Alinghi design team, starting from a completely blank sheet of paper, with no preconceived multihull ideas. We started designing it and building it and we've done a lot of sailing and testing on ‘Le Black' and the Décision 35s so we've incorporated some of the ideas we've picked up sailing these boats.

The focus of the concept and the design and build of the boat has been on what we need to sail a Deed of Gift Match: up/down racing of 20miles. We haven't focused on the other team at all, only concentrating  on what makes our boat go the fastest. It's been a big job for quite a small design team and we'll see the results soon.”

Le catamaran d'Alinghi dévoilé

Alinghi, Defender de la 33e America's Cup, a dévoilé son catamaran de 90 pieds ce week-end à Villeneuve en Suisse. Ce bateau est l'aboutissement du savoir-faire suisse en matière de multicoques et constitue la première étape de la préparation d'Alinghi pour la 33e America's Cup prévue en février 2010. Le catamaran sera mis à l'eau par hélicoptère la semaine prochaine sur le Lac Léman avant d'entamer le processus de mise au point et de sortir naviguer pour la première fois.

 Grant Simmer, coordinateur du design team: “Tout d'abord ce bateau n'existe que grâce à l'engagement sans faille d'Ernesto Bertarelli dans l'équipe et à son soutien et à son enthousiasme pour ce projet. Ce multicoque est une démonstration du talent et de la créativité des designers ainsi que du dévouement du chantier et de l'équipe technique qui ont su construire un bateau aussi complexe et résoudre les nombreux problèmes auxquels ils ont été confrontés. Enfin plus récemment, l'implication de l'équipe navigante a permis de définir un grand nombre des systèmes à bord. Ils ont travaillé avec les designers pour trouver les solutions les plus simples et les mieux adaptées à un bateau déjà très complexe".

 

 Rolf Vrolijk, premier designer: “Les gens qui découvrent le bateau pour la première fois sont surpris de voir à quel point il a l'air léger et fragile. C'est vraiment leur première impression. Pour créer ce bateau il a fallu un énorme travail d'équipe, que ce soit pour le design ou pour la construction. Son concept représente tout le potentiel de notre équipe. Nous avons réussi à aller aussi loin que nous le voulions et ce bateau est avant-tout une base pour d'autres aménagements à venir. Au cours des prochaines semaines, nous allons réunir un maximum d'informations pour les comparer avec les prédictions et commencer à optimiser le bateau. Nous avons plusieurs possibilités de faire évoluer le concept mais nous devons tout d'abord avoir une base solide sur laquelle commencer nos recherches.”

Il est en fait comme un petit bateau mais en version agrandie. C'est un catamaran finement conçu et très léger. Un véritable chef d'oeuvre. Alinghi 5 est une évolution de bateaux suisses comme le 41 pieds "Le Black". Le concept de base pour ce qui est de l'ingénierie vient d'ailleurs de ce bateau mais tout le reste est une création du design team d'Alinghi qui est parti d'une page blanche, sans idée préconçue sur les multicoques. Nous avons commencé à le dessiner et à le construire et parallèlement nous avons fait beaucoup de sorties en mer et de tests sur "Le Black" et en Décision 35, donc nous avons repris quelques idées issues de ces bateaux. Le concept, le design et la construction sont basés sur une question simple qui est de savoir ce dont nous avons besoin pour courir le Deed of Gift Match, une épreuve en aller-retour de 20 milles? Nous n'avons pas du tout pris en compte l'autre équipe et nous nous sommes concentrés sur ce qui rendra notre bateau plus rapide. C'est une énorme tâche pour un design team relativement petit. Nous verrons bientôt le résultat.”
